This Privacy Policy is intended to comply with the California Consumer Privacy Act (CCPA)
and the terms of service for application stores where the App may be available, including
those of Apple and Microsoft. Our Service is primarily intended for users located in the
United States.
By using our Service, you agree to the collection, use, and disclosure of your information

Terms of Service. If you do not agree with these terms, please do not
use our Service.

when you use our Service, and information we may receive from third parties.
Information You Provide Directly:
-
Account Information: If you create an account, we may collect your name,
email address, and password.
-
Contact Information for Leads and Inquiries: If you contact us for
support, express interest in our Service (e.g., as a lead), or other inquiries, we may
collect your name, email address, company name, phone number, and any other information
you provide.
Providing us with such information constitutes your consent for us to contact you
regarding our Service or your inquiry.
-
User Feedback: Information you provide when you report a problem, request
support, or otherwise communicate with us.
Information Collected Automatically Through the Site:
-
Log Data: When you visit our Site, our servers automatically record
information that your browser sends, such as your web request, Internet Protocol ("IP")
address, browser type, browser language, referring/exit pages and URLs, platform type,
number of clicks, domain names, landing pages, pages viewed and the order of those pages,
the amount of time spent on particular pages, and the date and time of your request.
-
Cookies and Similar Technologies: We use cookies and similar tracking
technologies to track the activity on our Site and hold certain information. Please see
our "Cookie Policy" section (Section 6) below for more details.
Information Collected Automatically Through the App:
-
Network Performance Data: The App monitors your network performance. This
includes data such as internet speed (upload and download), latency, packet loss, jitter,
Wi-Fi signal strength, and connected network hardware information (e.g., router and modem
model).
-
Device and System Information: We collect information about the device on
which you install the App, including operating system type and version, hardware model,
and system configuration.
-
Location Information: With your explicit permission, the App may collect
your precise or approximate location data. This is used to help diagnose network issues
that may be specific to your geographic area or to identify your Internet Service Provider
(ISP).
Location permission is also required to diagnose certain issues pertaining to WiFi
performance and connectivity, as some WiFi diagnostic information is only available when
location services are enabled on your operating system.
We use this information solely for diagnostic and service improvement purposes.
We do not sell your specific location data to any third parties.
-
Local Network Access: With your explicit permission, the App will access
and interrogate your local network. This allows us to discover devices on your network,
assess their connection quality, and identify potential configuration issues or
interference affecting your network performance. This access is solely for the purpose of
providing you with network monitoring and improvement suggestions.
-
Usage Data: We collect information about how you use the App, such as the
features you use, the frequency and duration of your usage, and diagnostic information
relating to the App's performance. This helps us understand how our users engage with the
App and how we can improve it.
What We Do NOT Collect: Network Weather does not monitor, intercept,
record, or analyze the content of your network traffic. We do not collect information about
websites you visit, applications you use, files you download, emails you send or receive, or
any other content transmitted over your network. Our diagnostics focus solely on network
performance metrics, not the substance of your communications or online activities.
Non-Identifiable Aggregate Data:
-
We reserve the right to collect and analyze data in an aggregated and de-identified form.
This means that the data is combined from multiple users and stripped of any information
that could personally identify you. Examples include statistics about network performance
issues experienced by users of a particular ISP or problems associated with specific
models of network equipment.
3. How We Use Your Information
We use the information we collect for various purposes, including:

For Research and Development: To analyze trends and to develop and
improve our algorithms and service offerings.
-
To Monetize Aggregate Non-Identifiable Insights: We may use aggregated
and de-identified data to generate insights about network performance, ISP issues, or
network equipment problems. These non-identifiable insights may be monetized.
We do not sell your Personal Identifiable Information (PII) to anyone.
-
To Train AI Classifiers: We explicitly reserve the right to train
artificial intelligence (AI) classifiers based on anonymized, aggregated insights derived
from the data collected through our platform. This helps us improve the accuracy of our
diagnostics, suggestions, and overall Service.

in the following circumstances:
-

third-party vendors, service providers, contractors, or agents ("Subprocessors") who
perform services on our behalf or help us operate our Service. These services may include
website hosting, data analysis, customer service, email delivery, payment processing, IT
services, and marketing assistance. We use services such as Google Analytics, Hubspot,
Cloudflare, Twilio, and Synthflow, and may use other Subprocessors in the future. These
Subprocessors are authorized to use your personal information only as necessary to provide
these services to us and are obligated to protect your information.
-

de-identified information that cannot reasonably be used to identify you with third
parties for various purposes, including for industry analysis, research, and to improve

notify you via email and/or a prominent notice on our Site of any change in ownership or
uses of your personal information, as well as any choices you may have regarding your
personal information.
5. MSP and Enterprise Deployments
Network Weather may be deployed by Managed Service Providers (MSPs) or enterprise IT
departments to endpoints used by their clients or employees. In these scenarios:
Data Controller and Processor Roles:
-
When deployed by an MSP or Enterprise: The MSP or enterprise organization
that deploys Network Weather acts as the "Data Controller" (or equivalent under applicable
law) for the personal information collected from their clients' or employees' devices.
Primatech Paper Co. LLC acts as a "Data Processor" on behalf of the MSP or enterprise.
-
Direct consumer use: When individuals download and use Network Weather
directly, Primatech Paper Co. LLC acts as the Data Controller.
MSP and Enterprise Responsibilities:
Organizations deploying Network Weather to third-party or employee endpoints are responsible
for:
-
Providing appropriate notice to end users about the deployment and data collection
practices of Network Weather
- Obtaining any necessary consents required under applicable law
-
Ensuring their use of Network Weather complies with applicable employment, privacy, and
data protection laws
-
Responding to data subject requests from their clients or employees, with our reasonable
assistance as needed
White-Label Deployments:
MSPs with white-label licensing agreements may rebrand Network Weather for deployment to
their clients. In such cases, the MSP's own privacy policy governs the relationship with
their end users, and the MSP assumes responsibility for privacy compliance. However, data
collected through white-label deployments is still processed in accordance with this Privacy
Policy and our data security practices.
Data Processing Agreements:
Enterprise and MSP customers requiring a formal Data Processing Agreement (DPA) should
contact us at
legal@NetworkWeather.com.
6. Third-Party Services and Subprocessors
As mentioned above, we utilize various third-party services to operate and improve Network
Weather. These services may act as subprocessors for your data. Key examples include:
-
Google Cloud Services: For cloud infrastructure, data storage, and
backend services that power our application.
-
Google Analytics: To understand website traffic and user behavior on our
Site.
-
Anthropic: For AI-powered analysis and diagnostic recommendations within
our Service.
-
Hubspot: For customer relationship management (CRM), marketing, and sales
activities, including managing lead information.
- Cloudflare: For website security, performance, and reliability.
-
Sentry: For application error tracking, performance monitoring, and
debugging to improve Service reliability. Sentry receives crash reports and performance
data but does not receive your IP address or other personally identifiable information.

Service Provider (ISP) and approximate geographic region. This helps diagnose regional
network issues and ISP-specific problems. Your public IP address is sent to ipinfo.io for
this purpose.

customer support interactions).
-
Synthflow: For AI-powered voice and communication automation services.
We select our Subprocessors carefully and require them to provide sufficient guarantees to
implement appropriate technical and organizational measures to protect your data. We may
update our list of Subprocessors from time to time.
